IMPORTANT - PLEASE READ CAREFULLY: These Terms contain disclaimers of warranties, limitations of liability, and a binding arbitration clause with a class action waiver. By using the Workout Buddies app or website, you agree to these Terms. Please print or save a copy for your records.

This document governs your use of Workout Buddies, owned and operated by DenHeen LLC d/b/a Workout Buddies (“we,” “us,” or “our”). By accessing or using our mobile application, website, or services (“Service”), you agree to these Terms of Service (“Terms”), our Privacy Policy, Subscription Terms, and any other policies referenced herein.

General

These Terms of Service (“Terms”) govern your use of the Workout Buddies mobile application, website, and related services (“Service”). By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Subscription Terms. We may update or modify these Terms at any time by posting an updated version, and continued use constitutes acceptance of those changes.

Intellectual Property

All materials within the Service are owned or licensed by DenHeen LLC and protected under copyright, trademark, and other laws. Content may be used only for personal, non-commercial purposes. No reproduction, modification, or redistribution is permitted without written consent.

User submissions (e.g., photos, comments, workout notes) grant us a royalty-free, worldwide license to use, display, and distribute within the Service. Any materials created for us are considered “works made for hire.”

Account and Registration

Users must provide accurate information when creating an account and are responsible for maintaining password security. We are not liable for unauthorized account use.

Age Requirement: By creating an account or otherwise accessing or using the Service, you represent and warrant that you are at least 18 years of age and are legally capable of entering into a binding contract in your jurisdiction. We may require you to confirm your age before completing registration, and we may suspend or terminate any account we believe belongs to someone under 18.

Health & Safety Disclaimer

Workout Buddies provides general fitness and wellness information and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a healthcare provider before beginning any fitness program. You voluntarily participate at your own risk. Stop immediately if you feel pain, dizziness, or discomfort.

No Medical Diagnosis or Treatment: Workout Buddies does not provide medical or mental health care, and no information within the Service should be interpreted as medical advice or therapy.

Individual Results Vary: Your personal results depend on many factors, including consistency, health status, and nutrition. We do not guarantee specific results from use of the Service.

Exercise Tracking Data: Exercise logs (sets, reps, weight) that you enter, and any statistics derived from Apple Health data (such as calories, heart rate, steps, or distance), are self-reported or provided by third-party device/sensor data. We do not verify the accuracy of this data, and it is provided for informational and motivational purposes only. It should not be used for medical decision-making.

Subscriptions & In-App Purchases

Workout Buddies offers premium memberships and one-time program unlocks. Most purchases are made and billed through Apple’s App Store. Some purchases may instead be made directly through our website, processed by SamCart and Stripe; see our Subscription Terms for how billing, renewals, and refunds differ between the two.

For App Store purchases:

Subscriptions renew automatically unless canceled at least 24 hours before renewal.
Manage or cancel anytime in Settings → Apple ID → Subscriptions.
Prices are in your local currency and may vary.
Free trials convert to paid plans unless canceled before trial end.
Refunds are managed by Apple, not Workout Buddies.
Posting, commenting, and reacting in the Community require an active premium subscription. Users on a free plan may view a limited preview of Community posts. Reporting and blocking are available to all users regardless of subscription tier.

User Content & Community Guidelines

Workout Buddies includes a Community area where you may post content including text posts, comments, reactions, and (where enabled) photos, that is visible to other users of the app.

By posting or otherwise submitting content, you agree that:

You will not post content that is unlawful, abusive, harassing, threatening, hateful, sexually explicit, spam, false, or infringing on the rights of others.
You will not impersonate any person or entity, interfere with the Service, or collect other users' data without their consent.
Content you post in the Community is public within the app and is not a private communication. Do not share anything you wouldn't want other users to see.
Photos uploaded to your profile, post-workout activity, or the Community are automatically screened for inappropriate content using Google Cloud Vision before they are shown to other users. Posts and comments are automatically screened for certain prohibited keywords and phrases (such as sexual solicitation, harassment, or spam/scam content) before they are published; content that is flagged may be blocked from posting or held for review.
We may, at our sole discretion and without prior notice, remove any content, restrict Community features, or suspend or terminate accounts, that we believe violates these Terms or our moderation policies.
All users, including those on a free plan, may report posts, comments, or other content — or the account responsible for it — that they believe violates these Terms, using the in-app reporting tools available on that content. We review reports and take action we deem appropriate, which may include removing content, restricting features, or suspending or terminating the responsible account, but we do not guarantee a particular outcome.
Reported or removed content and related moderation records may be retained by us after removal for review, safety, and legal compliance purposes, as described in our Privacy Policy.
All users, including those on a free plan, may block — and later unblock — other users directly from their posts, comments, or replies. Blocking hides that user's current and future content from your view across the Community, including their posts, comments, and replies to your content, and is one-directional. We do not disclose to any user whether or by whom they have been blocked.
Direct messages exchanged with Workout Buddies coaches are answered personally by a real member of our coaching team (not an automated or AI-generated response), and are provided for general motivational and fitness guidance only. They do not create a medical, clinical, or other professional advisory relationship, and are subject to the Health & Safety Disclaimer above.

Data, Privacy, and Security

We collect limited information to operate the Service, including profile data, workouts, and device analytics. Data is processed via Firebase, Cloudflare, and related services. We do not sell personal information.

You may request account deletion at any time by emailing support@workoutbuddiesapp.com. Once verified, your account and all associated data will be permanently deleted from our systems within 30 days. Deleted accounts and associated data will be permanently removed.

Online Commerce

Purchases made through linked merchants are governed by those merchants’ policies. We disclaim responsibility for third-party goods or services.

Limitation of Liability

Under no circumstances shall we or our affiliates be liable for indirect, incidental, or consequential damages resulting from the use of the Service, including but not limited to fitness injuries, reliance on exercise or Health data, lost data, content posted by other users, or unauthorized access. Use of the Service is at your sole risk.

Indemnification

You agree to indemnify, defend, and hold harmless DenHeen LLC, its officers, employees, contractors, and affiliates from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your Community content, or your infringement of any rights of a third party.

Testimonials

Testimonials and user stories appearing in the app or on our website reflect real experiences of users but are not intended to guarantee that anyone will achieve the same results. Your results may vary.

Electronic Communications

By using Workout Buddies, you consent to receive electronic communications from us, including emails, in-app messages, text messages, and push notifications related to your account and Service activity. You can manage notification preferences within the app.

Refund Policy

All payments are processed in U.S. dollars. Refunds for App Store purchases are handled by Apple. Refunds for purchases made directly through our website may be requested from us - see our Subscription Terms for details. Workout Buddies does not modify currency conversion rates.

Termination

We may suspend or terminate accounts that violate these Terms, including repeated or serious violations of our Community Guidelines. Sections regarding intellectual property, disclaimers, indemnification, and limitations of liability survive termination.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through binding arbitration in Maricopa County, Arizona, on an individual basis. Class actions and jury trials are waived.

Severability / No Waiver / Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Failure to enforce any right shall not be deemed a waiver. These Terms, together with our Privacy Policy and Subscription Terms, constitute the entire agreement between you and Workout Buddies.
