This document governs your use of Workout Buddies, owned and operated by DenHeen LLC d/b/a Workout Buddies (“we,” “us,” or “our”). By accessing or using our mobile application, website, or services (“Service”), you agree to these Terms of Service (“Terms”), our Privacy Policy, Subscription Terms, and any other policies referenced herein.

GENERAL

These Terms of Service (“Terms”) govern your use of the Workout Buddies mobile application, website, and related services (“Service”). By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Subscription Terms. We may update or modify these Terms at any time by posting an updated version, and continued use constitutes acceptance of those changes.

INTELLECTUAL PROPERTY

All materials within the Service are owned or licensed by DenHeen LLC and protected under copyright, trademark, and other laws. Content may be used only for personal, non-commercial purposes. No reproduction, modification, or redistribution is permitted without written consent.

User submissions (e.g., photos, comments, workout notes) grant us a royalty-free, worldwide license to use, display, and distribute within the Service. Any materials created for us are considered “works made for hire.”

ACCOUNT AND REGISTRATION

Users must provide accurate information when creating an account and are responsible for maintaining password security. We are not liable for unauthorized account use.

HEALTH & SAFETY DISCLAIMER

Workout Buddies provides general fitness and wellness information and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a healthcare provider before beginning any fitness program. You voluntarily participate at your own risk. Stop immediately if you feel pain, dizziness, or discomfort.

No Medical Diagnosis or Treatment: Workout Buddies does not provide medical or mental health care, and no information within the Service should be interpreted as medical advice or therapy.

Individual Results Vary: Your personal results depend on many factors, including consistency, health status, and nutrition. We do not guarantee specific results from use of the Service.

SUBSCRIPTIONS & IN-APP PURCHASES

Workout Buddies offers premium memberships and one-time program unlocks. Billing, renewals, and cancellations are handled exclusively by Apple’s App Store:

• Subscriptions renew automatically unless canceled at least 24 hours before renewal.

• Manage or cancel anytime in Settings → Apple ID → Subscriptions.

• Prices are in your local currency and may vary.

• Free trials convert to paid plans unless canceled before trial end.

• Refunds are managed by Apple, not Workout Buddies.

USER CONTENT & COMMUNITY CONDUCT

You agree not to post unlawful, abusive, obscene, or infringing material. We reserve the right to remove any content that violates these Terms or our moderation policy. Photos uploaded (e.g., post‑workout selfies) are automatically screened using Google Cloud Vision for inappropriate content.

You may not interfere with the Service, impersonate others, or collect user data without consent.

DATA, PRIVACY, AND SECURITY

We collect limited information to operate the Service, including profile data, workouts, and device analytics. Data is processed via Firebase, Cloudflare, and related services. We do not sell personal information.

You may request account deletion at any time by emailing support@workoutbuddiesapp.com. Once verified, your account and all associated data will be permanently deleted from our systems within 30 days. Deleted accounts and associated data will be permanently removed.

ONLINE COMMERCE

Purchases made through linked merchants are governed by those merchants’ policies. We disclaim responsibility for third‑party goods or services.

LIMITATION OF LIABILITY

Under no circumstances shall we or our affiliates be liable for indirect, incidental, or consequential damages resulting from the use of the Service, including but not limited to fitness injuries, lost data, or unauthorized access. Use of the Service is at your sole risk.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DenHeen LLC, its officers, employees, contractors, and affiliates from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

TESTIMONIALS

Testimonials and user stories appearing in the app or on our website reflect real experiences of users but are not intended to guarantee that anyone will achieve the same results. Your results may vary.

ELECTRONIC COMMUNICATIONS

By using Workout Buddies, you consent to receive electronic communications from us, including emails, in‑app messages, text messages, and push notifications related to your account and Service activity. You can manage notification preferences within the app.

REFUND POLICY

All payments are processed in U.S. dollars. Refunds are handled by Apple or the original payment processor. Workout Buddies does not modify currency conversion rates or issue direct refunds.

TERMINATION

We may suspend or terminate accounts that violate these Terms. Sections regarding intellectual property, disclaimers, indemnification, and limitations of liability survive termination.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through binding arbitration in Maricopa County, Arizona, on an individual basis. Class actions and jury trials are waived.

EULA AND APP STORE COMPLIANCE

By downloading or using Workout Buddies, you also agree to Apple’s Standard EULA:

SEVERABILITY / NO WAIVER / ENTIRE AGREEMENT

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Failure to enforce any right shall not be deemed a waiver. These Terms, together with our Privacy Policy and Subscription Terms, constitute the entire agreement between you and Workout Buddies.
